PEERSAFE PROTECTION PROGRAM
The following limits are placed on members with regard to the number and value of PeerSafe claims that can be filed in a given month or over a member�s lifetime:
TRADE CASH DISBURSEMENT POLICY Between March 24, 2008 and April 30, 2008, if your Trade Cash account balance is greater than $10, you may cash out your account by requesting a payment via the Peerflix website. If you have requested a payment, Peerflix will verify your account activity and, upon successful account verification, will either (at the option of Peerflix) send you a check or have our bank wire payment to you within approximately forty-five (45) days of the end of the calendar month in which you make the request. All payments are subject to a $10 processing fee and $10 will be deducted from your account balance prior to any payment being issue. Please note that all checks will be made payable to the member's name on the Peerflix account, and under no exceptions can a substitute name be used. Any uncollected trade fees, disputed transactions or other amounts owed will be deducted from these final payments. In no event, however, shall Peerflix make payments for any Trade Cash balance less than $10. Please note that if your account is found to be in violation of our Terms of Service or Service Policies, we may at any time withhold payment, charge back your account, and/or refund (at your expense) other members for movies that you have sent or claimed to send. In addition, if you are past due on any payment to Peerflix, we reserve the right to withhold payment until all outstanding payments have been made and or reduce any payments to you (or your Trade Cash balance) by amounts owed. In addition to all remedies stated here, Peerflix reserves the right to pursue any and all remedies available to it in law or equity. BONUS DISCS There are a variety of titles where the feature presentation is included on one disc while a second or third disc contains bonus features or extras. Peerflix encourages its members to send bonus discs but cannot guarantee that bonus discs will be included in trades via the Peerflix network. Members that receive only the feature disc of a multiple-disc set, may file a Damaged Claim via the My Trade History page. BILLING To buy and sell movies via Peerflix, members must have and maintain a valid credit card on file. Peerflix accepts Mastercard, Visa, American Express, and Discover as valid forms of payment. No other forms of payment are accepted at this time. You will be charged when you participate in the sale or purchase of movies or other Peerflix services/items, and you will be charged at or shortly after the time the item or items are ordered or shipped. For movies, US members will be charged a combined fee for the transaction and postage, while Canadian members are not charged a postage fee. Peerflix will also charge your credit card when you ask that your account be credited with Trade Cash or when your account balance reaches a pre-determined level, or, if you have an outstanding balance, it has been a pre-determined amount of time since you were last billed. If at any time Peerflix is unable to charge your credit card for monies due, Peerflix reserves the right to debit your Trade Cash balance, collect the funds through alternative means (and charge you for any fees associated with such collections) and your account and Trade Cash will be suspended until payment is provided. COMMUNITY STANDARDS Peerflix community features are provided as a service to members, and to assist in the exchange of ideas, tips, information, and reviews related to our service. You must be a registered Peerflix member to contribute to the community features, but anyone can view the content. Like any community, the forums and groups will be most valuable when everyone abides by certain basic guidelines and rules for online behavior. We want you to express your thoughts, concerns, and ideas, but we want you to do it in a way that doesn't interfere with the enjoyment of other members. In addition to these basic community standards, you also agree to abide by the Terms of Service and Privacy Policy.
CREDIT FOR OUTSTANDING TRADE CASH Peerflix allows you to use up to $30 in outstanding Trade Cash related to unconfirmed sends. This means that if you sent 10 movies valued at a total of $100, you can only use $30 of that Trade Cash to get movies you want until some of the sends are confirmed received by the recipient. SEND REQUESTS Peerflix sends an email to you and notifies you via the website when one of your movies is requested. When you receive a request to send a movie you are given 24 hours to take one of two possible actions: (1) send the title as requested, or (2) mark the title as �Keep� indicating that you are not yet ready to send it. If you mark the title as �Keep� or ignore the send request altogether, another member is then notified and also given 24 hours to take action. For the purposes of determining which member is sent the send request, Peerflix maintains your send history and rewards good senders with more opportunities to send. If you ignore send requests you may receive fewer opportunities to send your movies. In addition, if you reach a pre-determined threshold of ignoring send requests, all of the titles in your Have list will be marked as Keep. SECURITY POLICY While we cannot guarantee the security of your data on our servers, we make strong efforts to secure both the physical access and electronic access to the machines that contain your data. Our servers are protected by a key-card access system. This system will monitor and log all entries into the facility. The facility is monitored 24/7 by security personnel. See our Privacy Policy. We hate spam too! As a result, you have our promise that every Peerflix email program adheres to the CAN-SPAM Act of 2003. PEERBUX TO TRADE CASH CONVERSION We converted trading currency from Peerbux to Trade Cash on December 17, 2006. If you had a Peerbux balance at the time of conversion, your Peerbux were converted at a rate of $3.75 in Trade Cash for every Peerbux. However, if you purchased Peerbux at any time since the beginning of Peerflix and still had a positive Peerbux balance at the time of conversion, we converted those to Trade Cash at your actual purchase price. For example, if you bought 2 Peerbux for $10, we credited your account with $5 in Trade Cash for each of those 2 Peerbux. GENERAL Peerflix reserves the right, at its discretion, to modify these Service Policies at any time without notice by posting a new version on the Peerflix Site under the "Service Policies" hyperlink or elsewhere. Your use of Peerflix following such change constitutes your acceptance of the terms and conditions of the Service Policies as modified and the most current version of the Service Policies will supersede all previous versions. Peerflix operates a system to facilitate sales of movies between its members, but it is NOT the seller or buyer or otherwise a party to any such transaction. Further (and notwithstanding anything else), (a) Peerflix is not a bank, money transmitter, bailee, trust, trustee, fiduciary, principal, agent, broker, financial institution or the like and, accordingly, its only obligations to you are those expressly specified herein and in the Peerflix Terms of Service and the Peerflix Privacy Policy (the �Policies�), (b) your rights with respect to your account are only your express contract rights under the Policies and (c) if you are required by law or regulation to pay or withhold sales or income tax or other governmental assessment (or otherwise report transactions) in connections with activity involving the Peerflix system, it is your responsibility to do so outside of the Peerflix system and you will indemnify Peerflix from any consequences of your failure to timely do so. Peerflix may refuse to process transactions or activities or cash-outs with respect to accounts it, in its sole discretion, believes may be used (i) other than in accordance with or (ii) in violation of any law or regulation. Without limitation, unusual or excessive activity between particular accounts may be indicia of improper activity. You may not purchase more than $100 in Trade Cash for your account on any day and you may not purchase any Trade Cash if the purchase would cause your account to show a Trade Cash balance of $100 or more. These Peerflix Service Policies also incorporate and you explicitly agree to be bound by the Peerflix Terms of Service and the Peerflix Privacy Policy. |
